1. Legal Status of the Organization
Lokchetna for Humanity Welfare Foundation (“Foundation”) is a duly registered non-profit organization operating under the applicable laws of India, including but not limited to provisions relating to charitable trusts/societies and the Income Tax Act, 1961 (including Sections 12A and 80G, wherever applicable).
2. Binding Agreement
By making a donation through any mode (including website, UPI, bank transfer, third-party platforms, or offline contributions), the donor (“Donor”) enters into a legally binding agreement with the Foundation and agrees to these Terms & Conditions in full.
3. Nature of Donation
3.1 All donations made to the Foundation are voluntary, unconditional, and irrevocable contributions made towards charitable purposes.
3.2 Donations shall not be treated as consideration for any goods or services.
3.3 No donor shall claim any ownership, control, or decision-making rights over the utilization of funds.
4. Utilization of Funds
4.1 The Foundation shall make reasonable efforts to utilize donations for the specific cause selected by the Donor.
4.2 However, the Foundation reserves absolute discretion to reallocate funds to other programs or urgent needs in furtherance of its charitable objectives.
4.3 The Donor expressly waives any right to demand strict earmarking or refund based on utilization preferences.
5. Donation Acknowledgement & Tax Benefits
5.1 Official receipts shall be issued subject to successful realization of funds.
5.2 Tax exemption benefits under applicable provisions (such as 80G) shall be provided only if:
• The donation qualifies under law
• Complete and valid donor details are submitted
5.3 The Foundation shall not be liable for denial of tax benefits due to incorrect information provided by the Donor.
6. Refund & Cancellation Policy
6.1 Donations once made are non-refundable and non-cancellable.
6.2 Exceptions may be considered only in cases of:
• Duplicate transactions
• Technical/payment gateway errors
6.3 Any refund request must be raised within 7 days of the transaction with valid proof.
6.4 Approved refunds shall be processed at the sole discretion of the Foundation within a reasonable time.
7. Payment Terms
7.1 The Foundation uses secure third-party payment gateways.
7.2 The Foundation shall not be held liable for:
• Payment failures
• Unauthorized transactions
• Data breaches occurring at the payment gateway level
7.3 Donors are responsible for ensuring the accuracy of payment details.
8. Donor Representations & Compliance
The Donor represents and warrants that:
• Funds donated are from lawful sources
• Donation does not violate any applicable laws (including anti-money laundering laws)
• The Donor is not listed under any sanctions or prohibited lists
The Foundation reserves the right to reject or report suspicious donations to authorities.
9. Anti-Money Laundering & Regulatory Compliance
The Foundation complies with applicable laws including:
• Prevention of Money Laundering Act (PMLA)
• Foreign Contribution Regulation Act (FCRA), where applicable
Donations may be subject to verification and due diligence checks.
10. Use of Donor Information
10.1 Donor information may be used for:
• Issuing receipts
• Communication and reporting
• Legal and compliance purposes
10.2 The Foundation shall not sell or rent donor data but may disclose it if required by law.
11. Publicity & Media Rights
11.1 The Foundation may use photographs, videos, and reports of activities funded by donations for awareness and transparency.
11.2 Unless explicitly requested in writing, the Donor consents to the use of their name (without sensitive details) in donor acknowledgements.
12. Limitation of Liability
To the maximum extent permitted by law:
• The Foundation shall not be liable for any indirect, incidental, or consequential damages
• Total liability shall not exceed the amount of donation made
13. Indemnification
The Donor agrees to indemnify and hold harmless the Foundation, its trustees, employees, and affiliates from any claims, damages, or legal actions arising out of:
• Violation of these Terms
• Provision of false information
• Illegal source of funds
14. Force Majeure
The Foundation shall not be held liable for failure or delay in utilization of funds due to events beyond its control, including but not limited to natural disasters, pandemics, government restrictions, or civil disturbances.
15. Modification of Terms
The Foundation reserves the right to modify these Terms at any time without prior notice. Updated Terms shall be effective immediately upon publication on the website.
16. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India.
All disputes shall be subject to the exclusive jurisdiction of competent courts.
17. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms constitute the entire agreement between the Donor and the Foundation regarding donations and supersede all prior communications.
