1. Program Overview
The āMake A Day Specialā Program (āProgramā) is a voluntary charitable initiative operated by Lokchetna for Humanity Welfare Foundation (āFoundationā), allowing individuals or entities (āParticipantā) to sponsor and support welfare activities such as food distribution, clothing donation, medical aid, or similar social services on a selected date.
2. Binding Agreement
By booking, sponsoring, or participating in the Program (through website, offline, or any other mode), the Participant agrees to be legally bound by this Agreement.
3. Nature of Contribution
3.1 All contributions made under this Program are voluntary, non-refundable, and irrevocable donations.
3.2 Participation does not create any partnership, employment, or agency relationship with the Foundation.
3.3 The Participant shall not claim ownership, control, or legal rights over the execution of activities.
4. Activity Execution & Discretion
4.1 The Foundation shall make reasonable efforts to conduct the activity as selected (e.g., old-age home meal, orphanage support, etc.).
4.2 However, due to practical, logistical, or safety reasons, the Foundation reserves the absolute right to:
⢠Change location, beneficiaries, or type of activity
⢠Modify date or timing
⢠Combine or restructure activities
4.3 The Participant agrees that such modifications shall not be considered a breach of agreement.
5. Scheduling & Availability
5.1 Activity dates are subject to availability and confirmation by the Foundation.
5.2 The Foundation may reschedule due to:
⢠Government restrictions
⢠Weather conditions
⢠Operational constraints
⢠Emergency situations
6. Participant Presence
6.1 The Participant may attend the activity, subject to prior approval.
6.2 The Foundation reserves the right to restrict or limit physical participation for safety, privacy, or operational reasons.
6.3 Participants must maintain discipline, dignity, and respectful behavior toward beneficiaries.
7. Media, Photography & Publicity
7.1 The Foundation may capture photographs/videos of the activity for documentation, transparency, and awareness.
7.2 The Participant grants permission for:
⢠Use of their name (if applicable)
⢠Use of activity visuals across website, social media, and reports
7.3 The Foundation shall ensure dignity and privacy of beneficiaries at all times.
8. Branding & Recognition
8.1 The Foundation may acknowledge the Participant (e.g., āSponsored byā¦ā) at its sole discretion.
8.2 The Participant shall not use the Foundationās name, logo, or branding for commercial or misleading purposes without prior written consent.
9. Compliance with Laws
The Participant agrees that:
⢠Funds provided are from lawful sources
⢠Participation complies with Indian laws, including anti-money laundering regulations
⢠No activity shall be requested that violates ethical or legal standards
The Foundation reserves the right to refuse or cancel any booking deemed inappropriate.
10. Refund & Cancellation Policy
10.1 All bookings are non-cancellable and non-refundable.
10.2 Exceptions may be considered only in cases of:
⢠Duplicate payment
⢠Technical errors
10.3 In case of cancellation by the Foundation, the amount may be:
⢠Rescheduled for another date, OR
⢠Used for similar charitable activity
11. Limitation of Liability
11.1 The Foundation shall not be liable for:
⢠Any indirect or consequential damages
⢠Participantās personal loss, injury, or dissatisfaction
11.2 Activities are conducted on a best-effort and humanitarian basis.
12. Indemnity
The Participant agrees to indemnify and hold harmless the Foundation, its trustees, staff, and volunteers against any claims, damages, or liabilities arising from:
⢠Breach of this Agreement
⢠Misconduct during participation
⢠Illegal or unethical requests
13. Force Majeure
The Foundation shall not be responsible for delay or non-performance due to events beyond control, including:
⢠Natural disasters
⢠Pandemic situations
⢠Government restrictions
⢠Civil disturbances
14. Transparency Clause
The Foundation strives for transparency and may share:
⢠Activity photos/videos
⢠Reports or updates
However, exact execution may vary due to ground realities.
15. Modification of Agreement
The Foundation reserves the right to modify these Terms at any time. Updated terms shall be effective immediately upon publication.
16. Governing Law & Jurisdiction
This Agreement shall be governed by the laws of India.
All disputes shall be subject to the jurisdiction of competent courts.
17. Entire Agreement
This document constitutes the entire agreement between the Participant and the Foundation regarding the Program.
